Electric Bicycle Tours Terms and Conditions

Before requesting a service offered electronically on the 2wheelstours.com website customers should ensure that they have read and understood the terms and conditions as laid out hereunder as these terms and conditions will govern any subsequent contract.

Definitions

2 WHEELS TOURS & TRAVEL AGENCY: Refers to the A Group Travel Agency, whose ownership status is stated below:

CAN-KAL YAŞAM DEK. GIDA SAN. TURIZM INS. VE DIS TIC. LTD. STI.: Refers to thelegal entity with a licence for operating an A Group Travel Agency, acting in the capacity of the owner of 2 Wheels Tours (hereinafter referred to shortly as “2 Wheels Tours”).

USER/VISITOR: Refers to a natural or legal person who uses these websites for any purpose.

WEBSITES: Refer to the entire of the servicesprovided online on the websites www.2wheelstours.com, www.ebikeantalya.com and www.escooterantalya.com (hereinafter referred to shortly as www.2wheelstours.com).

 Languages

a. 2wheelstours.com website is currently available in English and Turkish.

b. Language Disclaimer - 2wheelstours pay great attention to the quality of the translation of its websites and Terms & Conditions. However, in the event of any discrepancy, the Turkish version shall prevail.

Terms & Conditions

1. Assumption of Risk. Renter acknowledges that the activities that are performed with electrical bike (E-Bike) include inherent dangers, including the risk of bodily injury and/or death. Renter assumes and accepts all risks associated with the use of E-Bike.

2. Acceptable Use. Renter agrees and acknowledges that he/she will be the sole operator of E-Bike, and will use E-Bike in a careful, safe and conscientious manner. Renter shall at all times observe and adhere to any rules and guidelines posted by Company, traffic rules and any applicable laws or regulations.

3. Prohibited Activities. Renter shall not violate any of the following rules and regulations during his/ her operation of E-Bike:

      • There are no passengers permitted on E-Bike unless expressly permitted by Company in writing prior to use.

      • There is no smoking while on E-Bike.

      • There is no use of alcoholic beverages, or any illicit drugs permitted while using E-Bike, and renter is prohibited from operating E-Bike under the influence of the above.

      • Renter agrees to operate E-Bike only on legal roadways and in a legal capacity.

      • Renter must wear relevant safety equipment at all times, including but not limited to a helmet and reflector vest.

4. Unsafe Use. If at any time Company determines that Renter has engaged in an unsafe or hazardous use of E-Bike, Company may immediately terminate the rental. Upon notification of termination, Renter must return E-Bike to the designated return area immediately. Company shall determine, in its sole discretion, whether any behavior or activity is "unsafe or hazardous."

5. Renter Qualifications. Renter hereby confirms that: (a) they are at lease 18 years of age and responsible for all equipment rented, or if a minor my Guardian must represent me and agree to all the terms of this release by signing; (b) renter is physically, mentally, psychologically, physiologically and emotionally capable of operating the rented equipment; (c) renter is able to comprehend and will comply with all of the instructions and safety requirements associated with the rented equipment; (d) renter is operating the rented equipment voluntarily and of his/her own free will.

6. Condition of E-Bike upon Return. The Renter shall return E-Bike to the designated return area in the same condition as it was in when given to Renter, excepting ordinary wear and tear. Renter shall be responsible for any damage caused to E-Bike during the rental period. Renter is also obliged to indemnify any damage to the electrical components. Renter shall be billed by Company for the full amount of damages caused by Renter during the rental period.

7. Renter Obligation. Renter is obliged to take good care of E-Bike taking all precautions necessary to protect E-Bike from loss and theft. Should any of the above occur during the rental period, the renter is responsible for all costs pertaining to the equipment and E-Bike.

8. Obligation to Hire Companion. In case the customer hires more than one E-Bike, he/she has to hire the companion to be appointed by the company as well. In this way, the customer will be free from the obligations that might arise in case e-bike is lost or stolen.

Online Contracting Procedure

a. 2wheelstours.com offers a range of services to which the suppliers have given their accord.

b. The contract becomes legally binding only when 2wheelstours.com receives confirmation from the supplier that the requested service is available and the customer of 2wheelstours.com has been notified of this fact by email. In the event of the service supplier being unable to provide the requested service, the customer will be informed and reimbursed the full amount by the same method as the payment was made.

c. The booking voucher which must be presented to 2wheelstours’s service supplier will be made available to you at the time of email confirmation by 2wheelstours.com. This should be printed out so that it is readily available for inspection by the service supplier when requested during the tour, activity and transfer. It is recommended that customers should print out and carry with them all communications between the parties in addition to the booking voucher itself.

d. It is strongly recommended that website customers read all the terms and conditions of the offers in detail, and carefully check the details of their reservations and confirmations before submitting their request to 2wheelstours.com

e. The liability for the provision of tour, activity and transfer services between the customer and the service supplier is restricted solely to those two parties between whom the service has been the contracted. 2wheelstours liabilities resulting from this agreement shall therefore be limited to those of a third-party broker between the customer and supplier. Any liabilities resulting from the provision of the tour, activity and transfer service shall be the sole responsibility of the service provider and their insurance companies.

No Liability for Credit Card Transactions

2wheelstours makes all reasonable efforts to ensure that all credit card and debit card transactions are secure. HOWEVER, if unauthorized charges appear on your credit card or debit card statement for any card used on this website at any time during or after you make your reservation, conduct your transaction or disclose your card details on this website, 2wheelstours shall not be liable or responsible in any way in respect of any damage or loss of whatsoever nature suffered by you arising from or in any way connected with said use, transaction or disclosure, subject only to any statutory rights which you may have.

 Cancellations - Changes

Any cancellation of contract must be made in writing by fax or e-mail addressed to the central  office of 2wheelstours. More than 48 hours from the date of commencement of the first tour, activity and transfer service described in the booking voucher 100% of amount will be refunded. Between 48-24 hours from the date of the commencement of the tour, activity and transfer service described in the booking voucher 50% of amount will be refunded. Less than 24 hours from the date of the tour, activity transfer service described in the booking voucher no amount will be refunded. Please contact customer service by email if you require a cancellation note to claim against your tour operator, airline, or travel insurance.

 Any changes must be sent in writing by email to info@2wheelstours.com prior to the date of travel. More than 24 hours from the date of commencement of the tour, activity and transfer service described in the booking voucher, changes are available without extra payment, less than 24 hours of tour, activity and transfer date extra payment acceptable depends on supplier and changes, the customer is liable for any increased service cost resulting from requested change. All changes subject to availability & acceptance by supplier.

No Liability

a. Prior to making a booking, you should ensure that you have reviewed the travel services provider's terms and conditions and that they are acceptable to you.

b. 2wheelstours shall not accept any liability for losses, additional expenses or any claim for any obligatory hangs in accommodation or other travel services due to your sickness, weather, strikes or any other cause. All such losses, additional expenses or claims will be borne by you unless otherwise agreed.

Neither 2wheelstours.com nor any of its directors, employees, affiliates or other representatives will be liable for loss or damages arising out of or in connection with your use of any information, products, services, and/or the materials offered through this website, including but not limited to, loss of data, income profit or opportunity, loss of or damage to property and claims of third parties, or any indirect or consequential loss or damage, or such loss or damages were reasonably foreseeable.

c. We do not accept responsibility for any information about the service that we pass on to you in good faith. Information about services, mode of transport, journey times, pick up and drop off times and distances are approximate and for guidance only and not a commitment by 2wheelstours.com that they will be provided as stated on our website.

d. Your Supplier will make all reasonable efforts to arrive at the pick-up point at the time specified on your voucher, but this is not guaranteed. We accept no liability for this delay or any additional services for delays.

e. For private transportation services from the airport, the driver shall wait a maximum of 60 minutes from the time of flight arrival specified on your voucher. The waiting time by the driver from any other pick up point shall be restricted to 15 minutes from the time stated on your voucher.

f. It is your responsibility to check the date, time and location on your voucher or subsequent e-mail communication from us for the pickup details of your transport service. You must ensure that the arrival time at the departure airport allows you to arrive least 10 minutes before the check-in desk opens (not closes) and under no circumstances less than two hours prior to the scheduled flight departure time.

g. Please note most Suppliers will not be liable for paying any compensation for any delays, cancellations or missed services due to unforeseeable circumstances or events beyond their control, including, without limitation, accidents suffered by third parties on the transportation route, police checkpoints, acts of terrorism or vandalism, extreme weather conditions or strikes.

h. The transport shall be carried out between the points of origin and destination specified on your voucher. It is your responsibility to provide a complete and accurate address that includes a street name and number. With private transport, the vehicle shall take you to, or pick you up as close as possible to your accommodation, taking into account the physical characteristics of the vehicle and access to the contracted address. The category of vehicle in which the transport service shall be provided is not guaranteed and the Supplier has absolute discretion to substitute the vehicle without liability to you. Sometimes the vehicle may need to be substituted if it means that the service can be provided in circumstances where it would not otherwise be possible

j. For private transfer, if you fail to be at the pick-up point within 15 minutes of the time specified on your voucher the supplier will try to contact you on the mobile telephone number you have provided. If it is not possible to speak to you by reason of no or poor connection, no signal, the voicemail is on or the call is unanswered, the service will not be provided and your supplier is not obliged to provide you with the service and a refund will not be made.

 All vehicles are insured in compliance with local law.

Modification of these terms and conditions

2wheelstours reserves the right to change these terms as well as the contents of this website for any reason and without notice, and without liability to you, any other user or any third party. This right shall not affect the terms accepted by you upon making a legitimate reservation or purchase using this website. You should check these Terms for any changes each time you access the website.

 You undertake to (2wheelstours.com) that you will not use this website for any purpose that is unlawful or prohibited by these Terms.

You confirm that you are of sufficient legal age to use this website and to create binding legal obligations for any liability you may incur as a result of the use of this website. You understand that you are financially responsible for all uses of this website by you and those using your  information.

Other Provisions

Any dispute that may arise as a result of access to / use of these websites shall be governed by the Laws of the Republic of Turkey, and the place of jurisdiction for the settlement of such disputes is Antalya Courts. In case of any disputes arising between the parties, the records of 2 Wheels Tours shall be taken as a basis.
